The government will lay secondary legislation to explicitly exempt ‘brand advertising’ from the advertising restrictions. This will provide absolute clarity in legislation of the existing policy intention that brand advertising which does not identify a specific less healthy food or drink is not in scope of the restrictions.
This consultation seeks views on the specific text in the draft brand advertising exemption regulations (the draft regulations) to ensure it is clear and fit for purpose in achieving the government’s policy intentions.
